Seller, Consignment & Buyout Terms and Conditions

These Seller, Consignment, and Buyout Terms and Conditions (“Terms”) govern all transactions between you (“Seller,” “Consignor,” or “you”) and Clotheshorse Anonymous (“CHA,” “we,” “us,” or “our”), located in Dallas, Texas.

By submitting items to CHA, you agree to these Terms.

1. Services Overview

Clotheshorse Anonymous offers two selling options:

A. Consignment (All Accepted Categories)

Items are listed for sale, and you are paid after they sell. Consignment is available for all categories CHA accepts luxury & contemporary designer pieces, including apparel, shoes, handbags, jewelry, and accessories. Please review the accepted brand list here.

B. Buyout (Direct Purchase – Limited Categories Only)

CHA currently offers buyouts only for the following categories:

  • Luxury designer handbags
  • Luxury designer wallets and small leather goods
  • Fine and designer jewelry

All other items are consignment only.

CHA reserves the right to determine, at its sole discretion, which service applies to submitted items.

2. Eligible Items

CHA accepts select women’s luxury designer and contemporary brands:

  • Apparel (consignment only)
  • Shoes (consignment only)
  • Handbags (consignment or buyout eligible)
  • Wallets / small leather goods (consignment or buyout eligible)
  • Jewelry (consignment or buyout eligible)
  • Accessories (primarily consignment)

Items must be:

  • Authentic
  • Clean and in excellent condition
  • Current in style and resale demand

CHA may reject any item for any reason, including brand, condition, seasonality, or inventory needs.

3. Submission Process

Items may be submitted:

  • For Consignment
    • In-store weekday walk-ins or Saturdays by appointment
    • Via approved pickup or courier services
  • For Buyout
    • Through online submissions only (photos and descriptions) via this form.

You must provide accurate descriptions and images.

CHA may request additional information before proceeding.

4. Pricing & Valuation

CHA retains full discretion to determine:

  • Whether to accept an item
  • Pricing for consignment
  • Buyout offer amounts

Valuation is based on:

  • Brand
  • Condition
  • Market demand
  • Comparable resale values

CHA may adjust pricing, discount items, or include them in promotions at any time.

5. CONSIGNMENT TERMS

5.1 Listing & Sales

Accepted consignment items are listed for sale in-store and/or online.

5.2 Commission & Payment

You receive payment after items sell, according to CHA’s commission structure.

Payment methods may include:

  • Direct deposit (ACH)
  • Store credit
  • Check by mail (includes a processing fee)

5.3 Consignment Period

Items remain active for a consignment period determined by CHA. The consignment contract lasts 90 days from the processing date. Pricing may adjust throughout the consignment period in accordance with CHA’s discount system, and additional promotions or flash sales may also apply.

5.4 Unsold Items

At the end of the consignment period, items may be:

  • Discounted
  • Returned (pickup or shipped at your expense)
  • Donated

Consignors are responsible for monitoring their account and timelines.

6. BUYOUT (DIRECT PURCHASE) TERMS

6.0 Category Limitation

The Buyout program is strictly limited to:

  • Handbags
  • Wallets and small leather goods
  • Jewelry

Items submitted outside of these categories will not be considered for buyout and may be:

  • Redirected to consignment, or
  • Declined

6.1 Buyout Offers

After review, CHA may issue a Buyout Offer.

  • Offers are not guaranteed
  • Offers are typically valid for 7 days

6.2 Shipping

If you accept a Buyout Offer:

  • CHA may provide a prepaid shipping label (at its discretion)
  • Items must be shipped promptly
  • Items must match submitted descriptions

6.3 Inspection & Authentication

Upon receipt, CHA will verify:

  • Authenticity
  • Condition
  • Completeness

6.4 Revised Offers

If discrepancies are found:

  • A revised offer may be issued, or
  • The item may be declined

If declined or rejected, return shipping fees may apply.

6.5 Payment

After approval, payment is issued via:

  • Consignor Balance for in-store use or a consignment check on the 1st of the month
  • Check in-person (valid ID required)
  • Check by mail (up to 14 business days; fee may apply)
  • PayPal (1-2 business days after processing)

Check & PayPal payments may include a small processing fee.

6.6 Ownership Transfer

Once payment is issued, ownership transfers fully to CHA. All buyout transactions are final.

7. Authenticity & Seller Responsibility

You represent and warrant that:

  • You legally own all submitted items
  • All items are authentic
  • Items are not stolen or encumbered
  • Descriptions and images are accurate

8. Counterfeit or Misrepresented Items

If an item is found to be counterfeit or misrepresented:

  • It will not be accepted or purchased
  • Return shipping and/or authentication fees may apply
  • CHA may refuse future submissions
  • CHA reserves the right to take legal action where applicable

9. Fees

CHA may charge fees, including:

  • Return shipping
  • Authentication review
  • Check processing
  • Pickup or courier services

Fees may be deducted from payouts where applicable.

10. Seller Account

You are responsible for:

  • Maintaining accurate contact and payment information
  • Monitoring your consignor account
  • Tracking item status and timelines

11. No Guarantee of Sale or Purchase

CHA does not guarantee:

  • That items will sell (consignment)
  • That items will receive buyout offers
  • Any minimum payout amount

12. Final Sales

All buyout transactions are final.

Retail customer sales are subject to CHA store policies.

13. Limitation of Liability

CHA is not responsible for:

  • Items lost or damaged outside CHA-controlled shipping
  • Errors in submitted information
  • Delays caused by carriers or payment processors

14. Modifications

CHA may update these Terms at any time.

Continued use of services constitutes acceptance of revised Terms.

15. Violations

Violation of these Terms may result in:

  • Refusal of service
  • Account suspension
  • Fees
  • Legal action, where applicable

16. Governing Law

These Terms are governed by the laws of the State of Texas.
