CONSIGNMENT TERMS & CONDITIONS
CONSIGNMENT PAYOUTS – Checks are issued on the 1st of every month if your cumulative balance is more than $50 based on final net sales. You may use your account balance as store credit. Accounts with less than a $50 balance at the end of the contract will be issued store credit for the final balance. If your check is lost, we apply a $25 bank charge fee to your account. Please notify us of any updates to your mailing address & contact information.
CONSIGNMENT DETAILS – Clotheshorse Anonymous (CHA) is a women’s consignment store specializing in current designer & contemporary apparel, shoes, handbags, accessories, & jewelry. Our goal is to sell your items quickly & to maximize your payout. Appointments for consignment can be made online or by email. After your items are authenticated & priced, you may access your account on our website under “Consignor Access” to see both active & sold items. We also offer front porch pick up & courier service to qualifying accounts – fees may be charged.
CHA reserves the right to modify the terms of the consignment contract at our discretion & will use email & the consignor dashboard to communicate any changes.
CONSIGNMENT PERIOD – The consignment period begins on the day that your items are processed on your account & expires after ninety (90) days. If you decide to end your contract within the 1st thirty (30) days, there will be an early termination fee of $3 per item charged at POS. CHA may determine specific items are eligible for re-contracting, contract extension, & storage for the next season.
ITEM/INVENTORY CONDITION – We consign current trend items that are clean & gently worn. Our consignment team will determine sellable categories & designers based on sell-through reporting & shopper buying patterns. Items will be selected at the consignment team’s discretion.
Please bring your items in clean & on hangers. Inspect your items carefully. We work to ensure all items we take are free of stains, odors, pet hairs, holes, rips, tears, and the like; however, items found to have unnoticed defects during processing will be considered unsellable & will be donated without notification.
*A $1.00 per item cleaning fee will be charged to the account for items with excessive wrinkling and/or pet hair.
Any cleaning and/or repair charges for salvageable items will be deducted from your account (e.g. steaming, dry-cleaning, jewelry repairs). Additionally, a buyer's surcharge is added at the point-of-sale. This is in lieu of a processing fee and does not affect the split between you and Clotheshorse Anonymous.
Our fur season is from October 15th to March 15th. We will limit fur inventory & will give preference to capes, shrugs, vests, & fur accessories. Fur pricing will be dependent upon client receipts & records.
Boxes are accepted by mail from out-of-town clients. Items from boxes must meet all consignment requirements & defective items will be donated without notice.
PRICING – Pricing & markdowns are at our discretion to be competitive in the resale market & to account for current economic changes. Designer handbags & precious jewelry pricing will be determined by you with the consignment team. Items will be marked down after 30 & 60 days during the contract period. Additionally, during the year we may host seasonal sales, flash-sales, or have additional markdowns based on inventory levels & shopper demand.
UNSOLD ITEMS – It is your responsibility to claim & retrieve your unsold items You may pull your items from the sales floor yourself at no cost to you before the end of your contract. Any unsold items that are not picked up will be donated to a local charity or become the property of Clotheshorse for disposition. We can provide you with a donation receipt upon request.
LOST OR DAMAGED ITEMS – We do our best to protect your items while in our possession. CHA is not responsible for items that are damaged or lost during the consignment period.
ONLINE – At our discretion, we will list select items to sell both in-store & on multiple online selling platforms based on shopper demand (e.g., Golden Goose sneakers). The increased exposure online will give these items an opportunity to sell at full price & quickly. Your account may be charged a small fee to cover the online processing fees.
DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY: YOU EXPRESSLY UNDERSTAND AND AGREE THAT: YOUR USE OF CHA’S SERVICES IS AT YOUR SOLE RISK. THE CHA CONSIGNMENT AND OTHER SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. CHA EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. CHA MAKES NO WARRANTY THAT (A) CHA SERVICES WILL MEET YOUR REQUIREMENTS OR (B) CHA’S SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, THAT YOU OBTAIN FROM CHA OR THROUGH OR FROM THE SITE OR CHA’S SERVICES SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS. CHA AND ITS SUBSIDIARIES, AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, AND LICENSORS SHALL NOT BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES OR FOR DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR FOR OTHER INTANGIBLE LOSSES (EVEN IF CHA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES) RESULTING FROM: (A) THE USE OR THE INABILITY TO USE CHA’S SERVICES OR THE SITE; (B) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (C) THE ACTIVITIES CONTEMPLATED BY THIS AGREEMENT; OR (D) ANY OTHER MATTER RELATING TO THE CHA’S SERVICES OR THIS AGREEMENT. IN NO EVENT WILL CHA'S LIABILITY UNDER THIS AGREEMENT EXCEED THE AMOUNT IT HAS ACTUALLY RECEIVED AS A RESULT OF SELLING YOUR PROPERTY HEREUNDER.
THE FOREGOING DISCLAIMERS AND LIMITATIONS ARE A FUNDAMENTAL PART OF THE BASIS OF CHA'S BUSINESS, AND CHA WOULD NOT ENTER INTO THIS AGREEMENT WITHOUT SUCH DISCLAIMERS AND LIMITATIONS. PLEASE SEEK THE ADVICE OF APPROPRIATE PROFESSIONALS REGARDING THE TERMS OF THIS AGREEMENT AND THE EVALUATION OF ANY SPECIFIC OPINION, ADVICE, PRODUCT, SERVICE, OR OTHER CONTENT.
